These Terms of Use (“Terms”) govern your access to and use of any website, mobile site, portal, donation form, social-media page, or other online service (collectively, the “Site”) operated by The Heracles Group (“THG,” “we,” “our,” or “us”). By accessing, browsing, or using the Site you agree to be bound by these Terms and by our [Privacy Policy]. If you do not agree, do not use the Site.

1. Eligibility & User Conduct

You must be at least 13 years old (or the age of digital consent in your country) to use the Site.
You agree to use the Site only for lawful, non-commercial purposes and in a manner that does not infringe the rights of, restrict, or inhibit anyone else’s use of the Site.
Prohibited conduct includes (but is not limited to) uploading malware, engaging in data-mining, harvesting email addresses, impersonating others, or posting material that is defamatory, obscene, hateful, or otherwise unlawful.

2. Donations & Transactions

All donations are final and non-refundable unless a specific reversal is required by applicable law or expressly offered by THG.
THG uses third-party payment processors; we do not store complete card numbers. By donating, you agree to those processors’ terms and privacy notices.
We issue electronic receipts; paper copies are available on request.

3. Intellectual Property

Ownership:All text, graphics, photographs, videos, trademarks, and other materials on the Site (“Content”) are owned by THG or its licensors and are protected by U.S. and international IP laws.
Limited Licence:You may view, download, and print Content solely for personal, non-commercial use, provided you retain all copyright and other proprietary notices.
No Modification:You may not modify, reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, or sell any Content without THG’s prior written consent.

4. User Submissions

Any text, images, videos, or other materials you submit to the Site (“User Content”) must be your own original work or you must have permission to share it. By submitting User Content you grant THG a worldwide, royalty-free, perpetual licence to use, reproduce, adapt, publish, and display that content in any media for THG’s non-profit purposes. You are solely responsible for your User Content.

5. Third-Party Links

The Site may contain links to third-party websites. THG does not control or endorse those sites and is not responsible for their content, privacy practices, or terms. Your interactions with third-party sites are at your own risk.

6. Disclaimer of Warranties

The Site and all Content are provided “as is” and “as available” without warranties of any kind, express or implied. THG disclaims all warranties, including but not limited to merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free, or that any defects will be corrected.

7. Limitation of Liability

To the maximum extent permitted by law, THG and its directors, officers, employees, or agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or revenues, arising out of or related to your use of the Site or Content, even if advised of the possibility of such damages. In no event shall THG’s total liability exceed one hundred U.S. dollars (US $100).

8. Indemnification

You agree to defend, indemnify, and hold harmless THG from and against any claims, liabilities, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of or in any way connected with your violation of these Terms or your use of the Site.

9. Modifications to the Site or Terms

THG may modify, suspend, or discontinue any part of the Site at any time without notice. We may also revise these Terms periodically; the “Last updated” date will change accordingly. Your continued use of the Site after changes are posted constitutes acceptance of those changes.

10. Governing Law & Dispute Resolution

These Terms are governed by the laws of the District of Columbia, USA, without regard to conflict-of-laws principles. Any dispute arising under these Terms shall be resolved exclusively in the federal or state courts located in Washington, D.C., and you consent to personal jurisdiction and venue in those courts.

11. Termination

THG may terminate or suspend your access to the Site, without notice, for conduct that THG believes violates these Terms or is harmful to other users, THG, or third parties.
